A non-EEA family member of an EEA national may apply outside the United Kingdom for an EEA Family Allowance to join their EEA family member in the United Kingdom if their EEA family member exercises the rights of the Treaty. Or they may apply to come to the United Kingdom with their EEA family member if their EEA family member comes to the United Kingdom for the purposes of exercising the rights of the Treaty.

For a term of six months, an EEA Family Permit is issued and the visa holder is entitled to work in the United Kingdom. A non-EEA national family member may have to prepare and request an application for an EEA Residence Card after arrival in the United Kingdom, which will be granted for a period of 5 years. After five years, the individual will be able to apply for an EEA Permanent Residence Card in the United Kingdom.

Who is eligible to apply for EEA Family Permit ?

The criteria for those who are eligible to qualify for an EEA family permit are somewhat similar to applicants for a residency card. 

  • Appropriate family member of the EEA national, i.e. spouse/civil partner.

  • Dependant parental or family member of an EEA national or their spouse or civil partner.

  • Direct family member of British residents

  • Extended family member, i.e. single spouse or other related family members.

  • Applicant with a derivative right of residence.

The processing times can vary depending on where an application for an EEA family permit is made. Standard turnaround times shall be up to 6 months. However, most of the applications are determined within 1-3 months.
