CEC and ECs - The Debate Over Legal Protection and Accountability | Section 16 CEC Act 2023 | Supreme Court Latest News
Big Supreme Court Update for UPSC GS-2 Polity! Supreme Court issues NOTICE to Centre & Election Commission of India (ECI) on 13th October 2026 challenging BLANKET IMMUNITY to Chief Election Commissioner (CEC) and Election Commissioners (ECs).
What is the Issue?
Section 16 of The Chief Election Commissioner and Other Election Commissioners (Appointment, Conditions of Service and Term of Office) Act, 2023 says:
"Notwithstanding anything contained in any other law... No Court shall entertain or continue any civil or criminal proceedings against any person who is or was a CEC or EC for any act, thing or word, committed, done or spoken by him when, or in the course of acting or purporting to act in the discharge of his official duty or function."
Who Challenged?
- Association for Democratic Reforms (ADR) filed PIL
- NGO Lok Prahari filed separate plea in Jan 2026
- Bench: CJI Surya Kant, Justice Joymalya Bagchi, Justice V Mohana
- Next Hearing: 2nd November & 6th November 2026 (Tagged together)
Arguments AGAINST Immunity (Petitioners):
1. Violates Article 14 (Equality) & Article 19 & Article 21 & Basic Structure
2. Blanket, Lifelong Immunity - Even after retirement, even Judges don't get this!
3. Only President has such protection under Article 361
4. Even PM, Supreme Court Judges can be prosecuted
5. Shields arbitrary power, corruption from judicial scrutiny
6. Procedural impropriety - Section 16 added via executive amendment late in legislative process when many Opposition MPs suspended (Dec 2023)
7. Justice Bagchi observed - "Post-retirement immunity not given to even judges"
Arguments FOR Protection (Govt/ECI side expected):
1. Needed for independence of ECI - Article 324 - Free & Fair elections
2. Protect from frivolous, vexatious litigation by political parties
3. Similar to Judges Protection Act, 1985
4. Ensures CEC/ECs can act fearlessly without fear of prosecution
