Jharkhand DGP Appointment Controversy Explained | Supreme Court Questions Selection Rules | UPSC Current Affairs 2026
Why in News? Supreme Court prima facie finds Jharkhand DGP appointment rules contrary to Prakash Singh Judgement 2006.
In this video by Vajirao & Reddy Institute, India's Top Potential Training Institute for IAS, we decode The Hindu + PIB + ET analysis:
What Happened?
- Centre challenges Jharkhand's Selection and Appointment of DGP Regulation, 2025 notified on Jan 8, 2025.
- On Dec 29, 2025, Jharkhand amended rules removing 6-month residual service requirement.
- Next day, Dec 30, 2025, IPS Tadasha Mishra appointed as DGP just 1 day before her superannuation on Dec 31, 2025.
- Earlier Anurag Gupta appointed Feb 2, 2025 with only 3 months service left.
Supreme Court Observation (Oct 8, 2026):
- Bench of CJI Surya Kant, Justice Joymalya Bagchi & Justice V Mohana.
- "Provision prima facie in teeth of Prakash Singh verdict" - If rule struck down, Mishra's appointment will be set aside.
- Notice issued to DGP Tadasha Mishra to be heard.
- State govt via Sr Adv Kapil Sibal said willing to revisit rules. Matter posted after 1 week.
- Amicus Curiae: Sr Adv Raju Ramachandran + UPSC to examine other states' rules too.
What is Prakash Singh Case? Police Reforms:
- SC Directions 2006: Send DGP proposals to UPSC in advance, UPSC to make panel based on seniority, service record & experience, State to appoint from panel only.
- No Acting DGPs, Minimum 2-year fixed tenure for DGP.
- Clarification March 2019: Officer must have at least 6 months residual service before retirement.
UPSC Relevance: GS2 Polity - Police Reforms, SC Judgements, Centre-State Relations, Institutional Autonomy.
This is crucial for UPSC Prelims + Mains GS2 + Essay.
