Supreme Court on Vande Mataram and Religious Freedom | SC Latest Judgement 2026 | Vajirao & Reddy IAS
Big Supreme Court Update on Vande Mataram! | Important for UPSC Prelims & Mains GS2
The Supreme Court of India on 22nd September 2026 heard plea against Vande Mataram mandatory singing and gave crucial observations on Religious Freedom.
Vajirao & Reddy Institute - India's Top Potential Training Institute for IAS explains this burning issue for UPSC 2026.
🔴 What Happened in Supreme Court?
Bench: CJI Surya Kant, Justice Joymalya Bagchi & Justice V Mohana
Case: Carnatic musician T M Krishna vs Union of India - challenging constitutional validity of 2026 Amendment to Prevention of Insults to National Honour Act, 1971
SC Observation: "We expect no criminal consequences for conscientious objectors to singing Vande Mataram on religious grounds. Person refusing on grounds of conscience under Article 25 & 26 should not face penal action."
The court asked Centre to file response. No formal notice yet.
🔴 What is the 2026 Amendment Controversy?
1. Centre made Vande Mataram at par with National Anthem under Prevention of Insults to National Honour Act.
2. Intentionally preventing singing or disrupting assembly singing Vande Mataram = Up to 3 years jail.
3. MHA Circular mandates singing COMPLETE 6 stanzas of Vande Mataram at official functions (earlier only first 2 stanzas were sung).
🔴 Petitioner's Argument - Why Objection?
T M Krishna argued last 4 stanzas of Vande Mataram invoke Hindu deities - Durga, Lakshmi, Saraswati. Compelling citizens to sing violates Secularism & Articles 25-26. It amounts to compelled religious affirmation and majoritarian message.
🔴 Supreme Court's Stand:
1. What is National Song? Not for Court to decide. It is for democratic state to decide whether 2 or 6 stanzas.
2. Bijoe Emmanuel vs State of Kerala 1986 Judgement Applies: SC protected 3 schoolchildren (Jehovah's Witnesses) who stood respectfully during National Anthem but did not sing due to religious beliefs. That law is still valid.
3. Balance: Vande Mataram status as National Song stands, but you can't thrust it with penal consequences.
🔴 UPSC Angle: GS2 Polity - Fundamental Rights Article 25-26 Freedom of Religion, Secularism, Bijoe Emmanuel case, National Symbols, Judicial Review.
